Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use Focal. If you use Focal on behalf of someone else, you confirm you are authorized to accept these Terms for them.

2. Your account

Some features require an account. You agree to provide accurate information, keep your login credentials secure, and take responsibility for activity under your account. You can delete your account at any time from Settings → Account → Delete Account in the app.

3. License to use Focal

Subject to these Terms, Focal grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app for your personal, non-commercial use on Apple-branded devices you own or control. Your use of the app through the App Store is also governed by Apple’s Licensed Application End User License Agreement (Standard EULA). Where these Terms and the Apple Standard EULA differ, the terms more protective of your rights apply to that subject.

4. Focal Pro subscriptions

Focal’s core features are free. Focal Pro is an optional auto-renewable subscription that unlocks premium features such as advanced analytics, every focus environment, app blocking, and priority study rooms. The subscription title, length, and price are shown in the app before you purchase, and prices may vary by region and may change with notice.

Billing and auto-renewal. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.

Managing and canceling. You can manage or cancel your subscription at any time in your App Store account settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current billing period. Deleting the app does not cancel a subscription.

Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.

Refunds. Purchases are processed by Apple, and refunds are handled by Apple under the App Store terms. We generally cannot grant refunds directly for purchases made through the App Store.

5. Acceptable use

You agree not to:

• Use Focal for any unlawful purpose or in violation of these Terms.
• Harass, abuse, or harm other people in study rooms, or share unlawful or infringing content.
• Attempt to breach security, access data that is not yours, or disrupt the service.
• Reverse engineer, decompile, scrape, resell, or create derivative works from the app, except where the law expressly permits it.

6. Your content

You own the content you create in Focal, such as your goals and focus sessions. You grant Focal a limited license to store, process, and display that content solely to operate the service for you — including showing your display name and status to participants of a study room you choose to join, as described in our Privacy Policy. You are responsible for the content you create and share.

7. Third-party services

Focal relies on third-party services, including Apple, Google/Firebase, and RevenueCat. Your use of the app may also be subject to their terms, and we are not responsible for third-party services or their availability.

8. Disclaimers

Focal is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, timely, secure, or error-free. Focal is a productivity tool to support your focus habits; it is not a medical, mental-health, or professional service, and should not be relied on as such.

9. Limitation of liability

To the maximum extent permitted by law, Focal and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim relating to Focal is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Termination

You may stop using Focal at any time and delete your account. We may suspend or terminate your access if you violate these Terms or to protect the service and its users. On termination, your license to use the app ends; provisions that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive.

11. Changes to Focal and these Terms

We may modify, add, or discontinue features, and we may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date and, where appropriate, provide additional notice. Your continued use of Focal after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of [insert your governing jurisdiction, e.g. State of California, USA], without regard to its conflict-of-laws principles. Nothing in these Terms limits any mandatory consumer-protection rights you have where you live.

13. Apple App Store — additional terms

These additional terms apply because you obtained Focal through the Apple App Store:

• These Terms are between you and Focal only, and not with Apple. Apple is not responsible for the app or its content.
• Your license to use Focal is limited to use on Apple-branded products you own or control, and as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for Focal. For support, contact us at support@focalapp.org.
• If Focal fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (to the extent applicable). Apple has no other warranty obligation for the app.
• Focal, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal, or regulatory claims, and claims that the app does not conform to applicable law.
• Focal, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes that party’s intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
